Cairns Pilates Barre (ABN 20306149237) studio operates at Unit 4 & 5/12 Danbulan Street, Smithfield Qld 4879.
This site is owned and operated by Cairns Pilates Barre. These terms and conditions include general terms and conditions for use of this Site, terms and conditions relating to the services provided by Cairns Pilates Barre on the site and in our studio.
Please read these terms and conditions carefully, as they apply to all customers that purchase online/in studio or attend a class at the Cairns Pilates Barre studio. Once a product or class has been purchased or attended, it signifies that the customer has read, understood and agreed to be bound by the Terms. If the customer does not agree with the Terms, they must cease usage of the studio, or any of Services, immediately.
Cairns Pilates Barre reserves the right to review and change any of the Terms by updating this page at its sole discretion.
Health and Wellbeing
Cairns Pilates Barre is committed to ensuring the health and wellbeing of all of our studio clients. All customers are required to inform the Cairns Pilates Barre studio and its instructors of any health risks, pre-existing injuries, illness, pregnancy, medical conditions or anything that may affect exercise practice before starting a class. Cairns Pilates Barre instructors and staff are not trained medical professionals, and Cairns Pilates Barre recommends that all customers seek medical advice before participating in any classes at the Cairns Pilates Barre studio.
Participating in any exercise or attending any events at the Cairns Pilates Barre studio is done so at the customer’s own risk. All new customers are required to sign a liability waiver.
Customers are responsible for the loss, theft or breakage of any personal belongings they bring into the studio.
All customers must dress in comfortable clothing that allows free movement. Form-fitting clothing is encouraged eg. Tights, crop and tanks in order to help Cairns Pilates Barre instructors be certain of correct alignment and technique.
Long hair should be secured to avoid getting it caught in equipment. Please remove jewellery such as bracelets, dangly earrings and necklaces. This is a safety issue and also to protect our beautiful equipment. Please avoid tights with zips on the back and metal medallions on shirts; this is to protect the equipment.
If customers choose to wear shorts to their workout, please ensure that fitted biking/compression shorts are worn underneath them.
Customers are required to bring a small towel and water bottle to every class.
Grip socks are to be worn at all times in the studio. (Please note – socks from trampoline parks etc are not designed for our classes and as such are not acceptable).
- Bootybarre classes – Our Studio is branded to bootybarre, therefore we request that only bootybarre socks be worn to bootybarre classes.
Bootybarre socks are available for purchase from the studio or online.
- Mat & Equipment Pilates – Grip socks must be worn to all Pilates classes for health and safety reasons. TOESOX are recommended and are available at the studio or online for purchase.
- Rhythm Row / Row Fusion / Pilates HIIT / Spin / Boxilates – Customers are required to wear enclosed sports shoes on the machines. Flexible shoes are recommended for comfort.
In consideration of customers who have allergies, please refrain from wearing perfume, fragrances, and cologne to the studio. To ensure customer safety and to protect studio equipment, customers must not wear any scented body lotion or sunscreen before coming to work out.
At the end of the session, customers must use the anti-bacterial spray provided to wipe to clean and sanitise studio equipment. Customers are also required to return all mats, balls, weights, bands and sliders to their original storage location.
For the safety and comfort of all customers and staff, any threatening or inappropriate behaviour will not be tolerated. This includes verbal, physical or psychological behaviours.
Please do not attend a class under the influence of drugs and/or alcohol.
All classes must be prepaid. Casual classes must be paid at the time of booking. To book into a class, customers must either have pre-purchased sessions in their account or pay upon booking for casual sessions. All classes are closed for bookings three hours prior to commencement time. No booking = no class. All classes are prepared ahead of time by instructors, who take into consideration the needs of those clients attending.
Out of consideration for the instructor and other clients, customers are expected to arrive 10 minutes before class is due to begin. Please be aware that customers arriving more than 5 minutes late for a class, may forfeit their spot. This is due to a higher risk of injury as the first 5 minutes of each class are crucial for warming up the body to reduce the chance of injury.
Cairns Pilates Barre reserves the right to make changes to the class schedules, opening hours, membership pricing and instructors at any time. In the event of studio closure, for any reason, a variety of classes will be made available online.
A minimum of two people is required for any class to proceed. Customers will be contacted via text, phone or email should a class be cancelled and the session will be returned to the connected Cairns Pilates Barre account. Please be aware classes are on a first come first serve basis. To avoid disappointment, classes should be booked up to 4 weeks in advance to reserve equipment in class.
If a class is fully booked, customers have the option to be added to the waitlist. Should a place become available then Cairns Pilates Barre will send an email confirming the class booking. Bookings secured via the Waitlist functionality can be checked under the My Schedule section in the Cairns Pilates Barre App. Securing a waitlisted position in a class is counted as a booking and therefore if a customer does not attend a class booked via the waitlist, they will be charged a cancellation fee. This cancellation fee will be the full cost of the class booked via the waitlist, but not attended.
All customers who sign up to a Cairns Pilates Barre Weekly Membership agree to the terms and conditions outlined on the Cairns Pilates Barre website. This agreement authorises the direct debit functionality and lists any conditions specific to the membership package. In the event of studio closure, for any reason, a variety of classes will be made available online.
Memberships cannot be shared with other clients, nor can the class allocations be transferred from one week to another. No refunds will be given after the purchase has been made via the Cairns Pilates Barre website or in the studio. A one off set up fee of $10.00 is charged separately to commence membership. Membership will automatically renew after the initial three month term is completed if notice to cancel has not been received as outlined.
No Show/Late Cancellation of Class on membership
Sessions are non-refundable and non-transferable. Failure to show or late cancel a class will result in a cancellation fee. A casual pass fee will be automatically debited from your nominated card.
Membership can only be paused for 1 x one week block every 12 months. Six months minimum membership must have passed before pausing of membership is allowed.
Non-payment of membership
As part of the membership agreement, Cairns Pilates Barre reserves the right to cancel bookings if a customer’s account is in arrears. These conditions will remain in place until outstanding fees are paid in full to Cairns Pilates Barre.
Notice to cancel memberships
All memberships are set to automatically renew after the initial 3-month mandatory commitment. If a customer chooses to terminate their membership agreement after the initial 3 month period has finished, a written request must be submitted to firstname.lastname@example.org. This must be submitted 30 business days before the membership is due to renew, to ensure that the membership does not automatically renew for another membership cycle. If this is not provided, the membership will automatically renew and the direct debit account will be charged. No refunds will be provided for customers who do not follow this procedure or provide written email notification.
Cairns Pilates Barre may change class prices and direct debit terms at any time. Cairns Pilates Barre will provide 30 days advance written notice of such changes. These pricing/direct debit terms changes are final and no refunds will be provided.
Class Allowances for memberships do not roll over from week to week.
It is the member’s responsibility to schedule their own classes using the Cairns Pilates Barre online booking app on Google Play and the iTunes Apple Store.
24 Hour Cancellation
All customers must provide 24 hours’ notice to cancel a class. If a customer does not give sufficient notice, the full casual fee for this class will be debited from the nominated account.
Cairns Pilates Barre does not accept cancellations via email, text, phone or social media channels. Customers must provide 24 hours notice via the Cairns Pilates Barre App. THIS CANCELLATION POLICY APPLIES TO EVERY CLIENT. NO EXCEPTIONS.
All classes at Cairns Pilates Barre including membership packages are non-refundable and non-transferable. Unused classes will not roll over to the next period.
If the customer is not satisfied with the services provided by the Cairns Pilates Barre or believes they are entitled to a refund, Cairns Pilates Barre requires the customer to provide written notification to email@example.com, outlining why the customer believes they are entitled to a refund. Cairns Pilates Barre will respond to the request within 14 business days.
Gift cards can be used to purchase classes and products at Cairns Pilates Barre studio and online. They are not redeemable for cash and are non-transferable. Cairns Pilates Barre does not offer refunds, transfers, suspensions or extensions on Gift Cards for change of mind, injury, illness, change of address or any other reason. All purchases are final and non-refundable.
Please park in the allocated spaces for reserved for Cairns Pilates Barre. There are 4 spaces clearly marked near the front of the building (1 is reserved for staff). There are 3 additional spaces at the back. Otherwise, please park on the street in allocated parking spaces or on Mount Millman Drive (on the other side of the park) and walk across.
Please respect the parking spaces allocated for Sunbird Orthodontics and Smithfield Dental and do not park in these parking spaces.
Customers that park on the grass verge outside the studio, do so at their own risk.

Cairns Pilates barre will take all reasonable measures to minimise any risk of injury, but Cairns Pilates Barre cannot be held responsible for any personal injury or loss as a result of participating in any of its classes.
The information available on or through this Site, and the Services supplied via or in connection with this Site or at the Cairns Pilates Barre studio do not constitute medical advice and it is the customer’s responsibility to determine, through obtaining appropriate medical advice, that they are fit and well and that such contents and services are suitable for them. Before commencing any exercise regime, all customers should consult their doctor or medical professional.
It is also vital that all customers supply Cairns Pilates Barre with correct information. The Cairns Pilates Barre studio cannot be held liable for any incorrect information supplied. Whilst the studio tries to ensure that all information contained on this web site (and provided as part of any Services or Products) is correct, Cairns Pilates Barre do not accept any liability for any error or omission and exclude all liability for any action the customer (their legal representatives, heirs) may take or loss or injury the customer may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by Cairns Pilates Barre.
The customer, their legal representatives and the customer’s heirs release waive, discharge and covenant, not to sue Cairns Pilates Barre and it’s instructors for any injury or death caused by their negligence or other acts.
The Site may include links to external sites and co-branded pages. Cairns Pilates Barre has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting, However, Cairns Pilates Barre is not responsible for the content of these sites and pages or for anything provided by them.
Subject to the important liability statement, Cairns Pilates Barre is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by the customer.
